Israel to free 500 Palestinians

Israel has approved a list of 500 Palestinian prisoners to be released in coming days, under terms agreed at last week's Middle East summit in Egypt.
Israeli officials described the move as a goodwill gesture to Palestinian leader Mahmoud Abbas, after both sides agreed to a ceasefire.

But Palestinians have said the list falls short of expectations.

Later, Israeli sources said the remains of 15 Palestinian militants would be handed over in Gaza on Monday.

The remains of the militants, who are said to have been killed in fighting with Israeli troops, will be given to the Palestinian Authority at the Erez border crossing.

Security officials were also to discuss on Sunday evening the transfer of several West Bank towns to Palestinian control..

The concessions are part of the ceasefire reached between Israel and the Palestinian Authority, and also include the repatriation of up to 60 deported Palestinians.

Confidence building

An Israeli official told the Associated Press news agency the prisoners to be freed had not been involved in violent acts against Israelis, and almost all had completed two-thirds of their sentences.

He said violent offenders could be released later if the ceasefire holds.

"If we see that things are positively developing on the ground, there will be other kinds of prisoners that will be presented to [a cabinet] committee," the official said.

Correspondents say that in order to shore up his position, Mr Abbas will need to secure the release of militants serving long sentences for attacks on Israelis, many of whom belong to Hamas and Islamic Jihad.

Under the agreement, a further 400 Palestinian prisoners are due to be released within three months.

A statement from Israeli Prime Minster Ariel Sharon's office said the release of the Palestinian prisoners could help build confidence between the sides and strengthen Mr Abbas' administration.

However, Palestinians have complained that most of the prisoners are nearing the completion of their sentences and are from Mr Abbas' Fatah movement.

'Unilateral decision'

Palestinian cabinet minister Saeb Erekat criticised Israel for carrying out the release without talking to the Palestinians.

"The Israelis are releasing these 500 prisoners in a unilateral decision without consulting us," he said.

"We urge the Israeli government that the next release will be done in total agreement between the two sides and through the ministerial joint committee that will be meeting tomorrow."

The prisoners to be released constitute only a small fraction of the estimated 8,000 Palestinian prisoners in Israeli jails.

Palestinians are demanding that all be freed - a demand Israel has refused to meet.

That's rather peculiar. What does it mean? Why should the Israelis need the agreement of the Palestinains to release prisoners? A call for agreement implies the possibility of not agreeing, yes? Does this mean that there are some Palestinian activist prisoners being held by the Israelis that the Palestinians now in charge don't want released? Yet?

Of course I understand that the Palestinians might want more prisoners released than the Isrealis are currently releasing. But that doesn't seem to fit the call for "agrrement" before additional prisoners are released. For example, suppose the Israelis decided to release ALL the Palestinians they hold. They need to get the Palestinian authorities to agree to that?

Cabinet approves prisoner release

Five hundred Palestinian security prisoners, convicted of everything from planting road side bombs to membership in a terror organization, may be released as early as Thursday, following the cabinet's unanimous approval of their release on Sunday.

The release of the 500 is the first batch of 900 security prisoners Israel agreed to release as a gesture to Palestinian Authority Chairman Mahmoud Abbas.

Prime Minister Ariel Sharon told the cabinet, which approved the list drawn up by the Justice Ministry, Shin Bet (Israel Security Agency), IDF, police and Prisons Service, that while the release is not "easy or simple," it may help Abbas "solidify his rule and increase trust between the two sides."

Shin Bet head Avi Dichter, asked if he supports the release, said he did, and added that the Shin Bet helped draw up the names.

The list of 500, none of whom have "blood on their hands," is slated to be published by the Justice Ministry within two days on the Prisons Service web site . The public will then have two days to appeal against the release of any of those on the list.

A special ministerial committee whittled down a list of some 716 names to 500, and presented those to the cabinet. Only one prisoner will need to receive a presidential pardon, since the others were either tried in military courts or held in administrative detention.

The cabinet decided, on a one time basis, to waive one of the criterion that guided other Palestinian prisoner releases over the last two years: that the prisoners must have already completed two-thirds of their sentences.

The list of prisoners to be freed does not include those who Israeli officials say have participated in attacks on Israelis or those who still have two years to serve in prisons or who have not completed two-thirds of their sentences, said Aljazeera correspondent Walid al-Umari in Ram Allah.

The first prisoners could be freed as early as Monday, al-Umari said.

Prime Minister Ariel Sharon announced last week that 900 prisoners would be freed, 500 in days and 400 in the next few weeks to bolster Abbas, who reached a ceasefire with the Israeli leader at a summit in Egypt five days ago.

Release may be appealed

Their names will first be published on a government website, giving the public an opportunity to appeal against the release of individual prisoners.

Freedom for about 8000 Palestinians in Israeli jails is an emotive issue for Palestinians, who regard them as heroes of an uprising against Israeli occupation that began more than four years ago.

"This is not an easy step, but this gesture possibly could help the Palestinian Authority solidify its rule and boost trust between the two sides," a government statement quoted Sharon as telling cabinet ministers.

The list of prisoners was unanimously approved by the ministerial committee dealing with the release of Palestinian prisoners and by the government, in separate votes Sunday.

About 25 percent of the Palestinians due to be freed are Hamas and Islamic Jihad militants, and the rest belong to the ruling Fatah movement.

Prime Minister Ariel Sharon said Sunday the prisoner release could assist the new Palestinian leadership.

"This is not an easy or simple process, but this gesture could help the Authority establish its rule and increase the mutual trust between the sides," he said.

Also on Sunday, Israeli security sources said that Israel will hand the remains of 15 Palestinian militants to Palestinians in the Gaza Strip as a gesture of goodwill on Monday.

The public will be given the opportunity to appeal the releases once the detainees' names are publicized on the Justice Ministry's Web site. The 500 prisoners were chosen from a list of 700 prepared by the Shin Bet security service. One prisoner, a woman, is likely to receive a pardon from President Moshe Katsav.

The ministerial committee determined that Qassam Barghouti, a son of jailed Fatah leader Marwan Barghouti, will not be released, even though Defense Minister Shaul Mofaz had promised Palestinian adviser Mohammed Dahlan that he would be freed.

Mofaz told the ministerial committee that after he gave his assurance, the security services informed him that Qassam Barghouti had been involved in a terror attack, meaning that he had "blood on his hands" and so could not be released. Earlier, security officials said he had been accused only of belonging to a terror organization.

Justice Minister Tzipi Livni, a member of the committee, said on Sunday the approved list sticks to the principle of not releasing Palestinian prisoners with "blood on their hands" - those who have killed Israelis.

The committee adopted Livni's proposal that it compile information about all Palestinians held in Israeli jails. The information will come from the Israel Prison Service and the Shin Bet and will be given to the Justice Ministry.

Some of the prisoners slated for release have not yet served two-thirds of their sentences, Livni said. The government has previously determined that only those prisoners who have already served two-thirds of their sentences should be released.

Foreign Minister Silvan Shalom asked Sunday whether the government should abide by its previous decision in this case as well. Sharon decided to maintain the criterion in principle but to allow room for amending it in certain cases, including the current prisoner release.

Deported militants will be allowed to return to West Bank
Israel will allow 56 deported Palestinian militants to return to the West Bank, Israeli and Palestinian officials said Tuesday.

The militants include gunmen exiled abroad after holing up in Bethlehem's Church of the Nativity in May 2002.

Palestinian sources said Israel will also return the bodies of 15 Palestinians killed during the intifada in attacks on settlements throughout the Gaza Strip. These moves come in addition to Israel's release of the 500 Palestinian prisoners.

"There was an agreement reached in principle that all Palestinians deported ... will return to their homes," Palestinian Negotiations Minister Saeb Erekat told Reuters, saying implementation was expected within two weeks.

An Israeli official confirmed the deal, saying it was reached as part of a cease-fire declared by Prime Minister Ariel Sharon and Palestinian Authority Chairman Mahmoud Abbas at last Tuesday's summit in Egypt.

Abbas and the PA's nominated interior minister Nasser Yussuf met a delegation of the exiles in Gaza and advised them of the agreement.

"Abbas told us we could return to our homes and would be recruited to the security branches in Bethlehem," one of the Nativity Church exiles, Khaled Hamdallah, told Haaretz.

Abbas told the exiles that the deported men include 26 of the 39 fugitive militants who took refuge in the Church of the Nativity. Under a covert deal on May 2002 between Israel and the late Palestinian leader Yasser Arafat, they were transferred to the Gaza Strip. Another 13 fugitives were deported to Europe.

It was also agreed to send the men who murdered minister Rehavam Ze'evi and the leader of the Popular Front Ahmed Sadat to prison in Jericho. The remaining exiles are administrative detainees who were imprisoned by Israel and were due to be released.

However, as of 2003 Israel started releasing them to the Gaza Strip, and forbade them to return to the West Bank.

Another 17 Palestinians have been deported from the West Bank to Gaza due to involvement in terrorism during the Palestinian intifada.

Most of the Nativity Church fugitives are members of the Palestinian defense organizations who took refuge in the church at the PA's orders.

Following Sunday's Cabinet decision, a list of the 500 prisoners to be released was to be published on an Israeli government Web site, and opponents will have 48 hours to lodge objections with the Supreme Court.

Israel agreed Saturday night to transfer security control of the West Bank city of Jericho to the Palestinian Authority, sources close to the talks between Israel's Defense Minister Shaul Mofaz and Palestinian officials said. Also Saturday evening, Hamas declared it was committed to the terms of the cease-fire agreed upon with Palestinian Authority Chairman Mahmoud Abbas and those announced at the Sharm el-Sheikh summit last Tuesday.

Hamas said it would avoid violating the cease-fire and targeting settlements in the Gaza Strip, as it did on Thursday. It blamed Israel for the violence and said the shooting of mortars against Jewish settlements came in response to an Israeli killing of Palestinians.

Trying to remove all the settlement can be an almost undoable task.

THE 'SETTLEMENTS' ISSUE

Once again, we're hearing that awful word again in the context of the Middle East debate. "Settlements."

That's what the conflict is all about, we're being told. That's why the Arabs are mad at the Israelis. That's the root of the violence, the terrorism, the hatred.

U.S. Ambassador to Israel Daniel Kurtzer raised the ugly specter of "settlement" recently in a speech last week. Kurtzer, the former ambassador to Egypt and one of the architects of the failed peace process, once again blamed Israel as an obstacle to peace.

"Israeli settlement activity cripples chances for real peace," he said. He also underlined with emphasis and a pregnant pause this conclusion: "Settlement activity must stop." What about these "settlements"? What are they? Why are they bad? Why should they be stopped?

I think most Americans and most non-Israelis draw certain mental pictures when they hear this term. I know I did before I began visiting "settlements" in Israel. I discovered they were not armed camps. They were not frontier outposts in alien territory. They were not fortresses built to grab more land for Jews. No. Much to my surprise, I found these "settlements" to be nothing more than communities - peaceful Jewish communities that don't interfere with nor abrogate anyone else's rights. They reminded me of suburban developments in Southern California more than threats to peace.

The word "settlement" itself is loaded. Who is a "settler" in the Mideast? According to the Arabs, only Jews are "settlers." But that simply is not the case.

Arafat himself was born in Egypt. He later moved to Jerusalem. If, at the moment, he is living in the West Bank, he is a "settler" there, not a native. Indeed, most of the Arabs living within the borders of Israel today have come from some other Arab country at some time in their life. They are all "settlers."

For instance, just since the beginning of the Oslo Accords, hundreds of thousands of Arabs have entered the West Bank or Gaza - and never left. They have come from Jordan, Egypt and, indirectly, from every other Arab country you can name - and many non-Arab countries as well. These surely aren't "Palestinians."

Since 1967, the Arabs have built 261 settlements in the West Bank. We don't hear much about those settlements. We hear instead about the number of Jewish settlements that have been created. We hear how destabilizing they are - how provocative they are. Yet, by comparison, only 144 Jewish settlements have been built since 1967 - including those surrounding Jerusalem, in the West Bank and in Gaza. Why is it that only Jewish construction is destabilizing?

The Arab "settlement" activity is not new. This has always been the case. Arabs have been flocking to Israel ever since it was created - and even before, coinciding with the wave of Jewish immigration into Palestine prior to 1948.

And that raises a question I never hear anyone ask: If Israel's policies make life so intolerable for Arabs, why do they continue to flock to the Jewish state? Why aren't they leaving in droves if conditions are as bad as they say?

The truth? There is more freedom under Israeli rule than there is in any Arab country. If you're a headstrong Arab, bent on protest, this is the place to be. Don't try throwing stones at Syrian police. You won't live long. Don't try publishing anti-kingdom newspapers in Saudi Arabia. You won't live long. Don't try fomenting revolutionary jihadism in Egypt. You won't live long.

So, sooner or later, those who are determined to protest, the professional agitators, the future Arafats of the Arab world all come to Israel. The Arab world is happy to be rid of them. This exodus serves two purposes - limiting the threat to Arab regimes and fanning the uniting flames of anti-Israel hatred. It's a population safety valve the totalitarian Arab world just loves.

Prior to 1900, the entire region was a barren wasteland with low populations of Jews, Muslims and Christians. No one had much interest in the Holy Land, as Mark Twain pointed out in his own travels to the area - until the Jews began to return.

Then the economic activity began. The jobs were created. The opportunities appeared. And then the Arabs came.

The "settlement" issue is a canard. It's a propaganda ploy to suggest that only Jews are newcomers to the region. The truth is there are lots of "settlers" and would-be "settlers" in the area - including Arafat and his friends.

By the way, under the Oslo Accords, there are no restrictions whatsoever on Israeli construction in Judea, Samaria and Gaza. None. Zip. Nada. Zilch. These "settlements" are perfectly legal. And I, for one, can see no legitimate reason for them to stop.

So let us not make the settlements the Issue.

There are 1,200,000 Arabs living inside Israel Proper...let us not make them the issue.

Just go ahead and make the borders to the two Countries, Israel inside its pre 1967 (green line) borders and Palestine in the Whole of the West Bank and Gaza and then move on from there.

Thirty-six years of war should be enough for such a small number of people, when you consider the World Population.
Allowing the Palestinian People to have their small state in the Whole of the West Bank and Gaza can solve this conflict.
There are 1,200,000 or so Arabs living inside Israel Proper.
There are 400,000 or so Jews living inside the West Bank and Gaza.
Trying to remove all the settlement can be an almost undoable task.
So Set the Borders for Israel to it Pre 1967 Border (Green Line) and have the State of Palestine inside the West Bank and Gaza.
If the U.N. can decide the Borders of Israel in 1948,
The U.N. can decide the Borders of Palestine in 2005.
You would end up with Israel with a majority Jewish Population and Palestine with a majority Muslim Population.
This would allow for the Israeli Military to Guard and Control the Israeli pre 1967 borders instead of confiscating Palestinian Land and Demolishing Palestinian Homes in the West Bank and Gaza that only goes to fuel the need for the Palestinian People to fight for their Freedom.
The Jews who do not like living in the new Palestinian State can feel free to move to Israel if they so choose.
The Arabs living inside Israel can feel free to move to the new Palestinian State if they so choose.
Almost every nation on earth has more then one ethnic group or religious group, so why not Israel and Palestine?
It would sure be better then the never-ending conflict we have right now.
