Landslide Risks

Suit Alleges PL Knew Logging Would Lead to Landslides

EUREKA - The Humboldt County District Attorney sued the Pacific Lumber Company for $250,000,000, on six counts of fraud and deceptive concealment in applying for its Environmental Impact Report (EIR) and Sustained Yield Plan in 1999. The suit alleges that PL lied to state and federal agencies so that it could log 100,000 additional trees on unstable slopes, thereby committing unfair business practices.

The suit alleges that PL did not reveal information it had that showed that the increased logging would result in landslides that would degrade the streams and water quality downstream.

The DA believes that withholding that information prevented compliance with the CA Environmental Quality Act requirement to "recirculate" the EIR.

In the last three days of the Headwaters Agreement, Pacific Lumber and its parent company Maxxam, refused to agree to the volume of timber the
California Department of Forestry (CDF) thought appropriate to protect wildlife, sustained timber yield, and other resources, such as watersheds and water quality. The suit alleges that Pacific Lumber pressured the state and federal agencies to convince CDF to increase the volume by allowing logging of unstable slopes. CDF relented one day before the deadline for the Headwaters Agreement that purchased the 3000 acres Headwaters Forest, and saved another 2500 acres of ancient redwoods for 50 years.

"This unprecedented action is a vindication of our 15-year battle with PL and the regulatory agencies to rein in PL's liquidation logging, which has caused tremendous property damages, nuisance flooding, loss of ancient redwood trees in state parkland, and polarization of our community," said Al Cook, a local chiropractor whose property values have been reassessed downwards due to flooding in his village of Freshwater.

"Fishermen and small logging enterprises have suffered because of PL's unfair competition, which has resulted in over-regulation due the severe environmental consequences of their irresponsible, and it turns out, illegal logging," said Rudy Langlois, a small timberland owner and Freshwater resident.

Ken Miller, a local physician active with the Humboldt Watershed Council, said:

"What has been most disheartening has been the complicity of our state and federal agencies in allowing PL to harm residents and the entire social, economic and environmental fabric of our community. Most recently, the water board has succumbed to political pressures, and the second executive officer in three years has resigned in the face of a board resolutely determined to protect PL's HCP rather than water quality. It is all related to this rate of cut that PL obtained fraudulently."

"We have learned from years of frustration how much political force PL and Maxxam have mobilized against good science and policy. The DA is showing the kind of integrity and courage that should be a giant moral inspiration to all citizens, and rejuvenate our faith that with the right people in office, the system can work," said Ralph Kraus, a retired science teacher and Elk River resident.

"We were worried from the start that this Headwaters Deal and HCP could sacrifice our property rights and destroy our community. Our Van Duzen watershed is being hammered. It gives us some hope that our government regulators were duped not complicit," said Sal Steinberg, a local elementary school teacher in PL's milltown of Scotia, who is a 23-year resident of Carlotta.

"We've been fighting so long for our rights and our property and our health and safety and gotten nothing but run-arounds and delays from the agencies who we thought should help us. I'd lost all faith in the system. It's almost too late now, but I'm starting to hope again," said Kristi Wrigley, half of whose 100-year old apple farm has been destroyed by PL's logging of Elk River.

The District Attorney's office has a gorgeous view. Situated four stories up, on the southwest corner of the county courthouse, a large window looks out over the streets of Old Town, the boats bobbing at the docks of Woodley Island marina, the trees of Indian Island, the thin stretch of north spit.

Anybody can sue any one, for any thing. But can you win?
The D.A. is wrong and will be proved wrong in court. But we will just have to wait and see.
By the way, is it at all strange that this happens just as the feds take a stand against head shops? And wasn't it 215 (in part) that got him elected? Pot is still a federal offence. And when he crashes into the states vs federal rights wall, he will need somthing to get southern Humboldt ot re-elect him. I think he is reading the writing on the wall. P.S. Don"t get me wrong, I am pro 215.

It's amazing that one can look at the millions of dollars that PL has already paid out to residents for property damage they have caused, and consider the 300+ violoations they have racked up and still feel that the DA is wrong with this suit. It's refreshing to hear a voice that hasn't been beaten down by the PL legal machinery. More power to him.

Damn your more conspiracy theory than i had given you credit for. Considering the complaint is 45 pages and this is a fact intensive case, I'm surprised it got file so quickly after Paul took office. The timing of the Feds doing the republicans dirtry work is mere coincidence. Yes biggist, things can happen at the same time.

And I doubt Mr. Gallegos would go to such length to file a suit using the county's time, money and resources if he didn't think that it would win. Fraud was committed and a majority of the people in the county know it. Fraud was committed on the AG at the time of the Headwaters scam and that will come out also. Now it's just time to let it play out.

Geez, you freakin hppies are all the same. You always feel that you're in the right, and never listen to anybody else. You are always running around pointing your nasty smoke stained fingers (look at yours, they're stained with cigarrette smoke aren't they?) preaching your god dam gospel about how you think that corporations and logging are the work of the devil himself. All the while you burn organiaclly grown peanut oil in your non-corporation built noncars, and wipe yourselves without paper each morning. You just don't understand just how vital this business is to this area. It provides jobs (thousands, even state jobs, even jobs for hippies), a tax base, and a product to legally export. And for some, a feeling of pride that he or she is helping someone attain the American dream, which you communists don't understand anyway. Well, what happens to the Humboldt County region when the timber industry is so crippled that nobody around here pays any taxes or contributes any revenue except those fuckin doctors up there on the hill in Arcata, and your low-life, criminal dope growing buddies that voted for Gallegos. What are you going to do? Where will you go to continue producing your product (paranoia and lies, and stinky clothes) You'll have nothing to do but get stoned, take your clothes off, and climb up in a tree. I'm sick of you being around here. You and like are not welcome in Humboldt County. Go away and never come back! We'll get along just fine without you! This is truly amazing.

Not only did a rancher win a pro per (pro se) suit a few years back about property damage due to Maxxam clearcutting (silt ruined his ranchland) but now the DA is finally reading an EIR and enforcing CEQA (and NEPA?) for the environment instead of automobiles and development.

Corporations are part of life, but who said that we sovereigns should forfeit our birthright to a perpetual limited liability person?

That the DA took Epic's information and is attempting to make a case out of it should surprise no one. Whether conservative or liberal, any politician will repay those that helped them to attain office. Now it is a matter of waiting to see if Epic gave Gallegos enough correct information to use. If not, it will destroy his career as a lawyer.
Odd that the DA wouldn't spend a little more time on the issue to make sure his case was more legitimate. Perhaps this is a case that he doesn't really want to win, but feels obliged to make a show for his supporters.

No matter what the truth behind the issue, Humboldt County is more split than ever before.

Finally, someone in a government position has taken a stand for justice and fairness. Finally, Maxxam/PL will get exposed for their deceptive ways.
At last, someone has the backbone to stand up to Maxxam/PL, and to call them on their crap.
Remember, the timber industry has only been in this area for less than a century...before that, this was wild land, full of indigenous people, and taken care of.
All this talk about this being a long-standing timber community is a bunch of crap. This land was invaded, and industry was established, after a violent period of extermination and relocation.
Corporate-industrial society will not last, because it is not sustainable. Hopefully, it will be stopped before the big timber bosses take everything that supports life from this area, and from this Earth.
No more marching towards our destruction!
The Earth must be respected, and all those who refuse to do so will eventually pay and will eventually be disempowered.
It's time to break the spell and the cycles of violence and destruction.
Maxxam's days of violence and unchecked greed in Humboldt Co. may be numbered.
This is the time for bridge building, because we all live here, and we'll have to brace each other for the transition...it's coming, so we might as well face it.
Sustainable forestry will be a reality.
Justice will be served.
No more fraud, no more deception, no more agency buy-outs by big timber, and no more corporate fascism.
Time to change your ways, Maxxam/PL:)

I think I figured out why all those logging trucks were circling the court house. Our D.A. was putting his ass so far out on the line that one of the drivers was hoping for the chance to knock it off. And after that meeting, I bet he is still looking for it.

Did the $250,000,000 go to the victims? Who was harmed by the fraud? Did they get compensated through the settlement? Or, did the settlement go into a general fund for victims of violent crime? People who lost home, family and career due to violent crime have not been compensated. Read more at http://www.green247.org/truth.htm. Who is accountable for disbursing the fine?
