Pacific Lumber spent considerable time and resources all last week trying to get tree-sitters off their land, but have not really gained much ground, since as tree-sitters have been removed, their trees have re-occupied by other activists. There were 25 arrests last week, several injuries to activists, and complaints filed by forest defenders with law enforcement about behavior and authority of climbers employed by the timber company, as protests of Pacific Lumber's liquidation logging continue unabated.

Eric Shatz, a tree pruner and climber hired by Pacific Lumber to extract tree-sitters from the giant old growth redwood trees has liability insurance with Northwest Insurance Co. of Eureka for his tree-limbing work, but probably not for placing young activists in harnesses and lowering them up to 200 feet to the ground. Last Thursday, Shatz and two other climbers chased a young woman from her platform 130 feet up the tree to the very top of the thick-barked tree, about 200 feet up, where she climbed without a safety harness on, in order to grab her and bring her to the ground. At one point, Shatz told her, "If you fall, I will say it was a suicide."

Observers concerned that Shatz is recklessly endangering lives in his contract work for PL are today bringing a video tape of a tree-sit extraction he carried out to Northwest Insurance.

In addition to the liability problem of endangering the lives of young activists, timber company climbers are carrying out law enforcement duties, breaking up blockades, making citizen's arrests and sometimes using pain compliance holds, as Humboldt County Sheriff's Dept. look the other way.

The tree sits are in the Freshwater watershed, east of Eureka, where local residents have long tried to prevent Pacific Lumber from cutting on steep slopes, bringing mud slides and stream sedimentation to this rural area on California's north coast.

On Sunday, March 23, a large rally was held near the tree-sits to elebrate tree-sitter Remedy's one year anniversary in the tree. Remedy was on the ground in the crowd of over-100 at the remote rally location in the vicinity of the tree-sits, having been taken from the tree and arrested Monday, March 17 after 362 days without touching the ground.

To the woman who posted the prior note: You should be aware that the vast majority of people in the area believe that your daughter has unilaterally decieded to place herself at risk. She chose to trespass. She chose to climb the tree. She chose to associate herself with Earth First. She chose to keep herself in the tree; she is not being forced to stay there. She chose to interfere with legally approved timber harvesting plans. She chose to interefere with the lives of loggers who -- like you -- have families to feed, children to clothe, mortgages to pay, and college tuitions to pay for. She chose and accepted these risks. It is an unfortunate situation of her own creation. This really has nothing to do with those who are now trying to remove her safely so that she no longer poses a risk to herself or those below. If she wanted to protest there are many ways she could have exercised her first amendment rights without breaking the law and placing herself in danger. She created this situation by her own decisions.

With all due respect bill. Are you suggesting that the woman who is living up in a tree can be tossed out from her perch and be essentially murdered without recrimination?

Most people agree and understand why the tree sitters put themselves at risk. It's like Gandhi's followers, who sat peacefully. It doesn't make it right or legal to beat them.

Americans admire those few who take the time and energy to live up to higher principles and so make a change for the better in our world.

hey curt, good to see you agaian. I gather you have been following but not commenting. Welcome back.

To tree mom, your lengthy response last week went unanswered. I am not at a loss for words; I had a family issue that demanded more attention than this silly stuff. I'll rebutt you later.

Enough bickering! I see it every day from both sides. I support the tree sitters and activists with all my heart and soul. But when you all go down to the level of petty insults, it becomes tiresome and repetitive.

If we (activists, etc.) continue to this we may end up giving out information that loggers and such should not know. For every insult we have they have another. If we simply don't respond to their 'ignorance' then we should have no problem with them. I know in the past I've been there getting back all the same, but I've stopped now. Do you understand what I'm saying? Just let them bash away, we’ll not suffer their insolence and wast our time and energy on such things.

No, no, nobody's suggesting that sitters can be thrown out of trees and killed without recrimination. It would be repugnant even if it were legal. The video of Annapurna being taken down showed that a lot of care was being taken down to ensure her safety. If a sitter undoes their safety line and falls to avoid arrest that's THEIR responsibility, just like a driver who gets into a high speed auto wreck running from a cop.
Now on the liability issue: there is an excellent case to be made that the Dirt Firsters who recruit naive young kids to endanger their lives in tree sits could be legally liable when the sitters get hurt or killed. Keep in mind that two sitters in Oregon have been killed already WITHOUT the help of extractors. And we know that a lot of Dirt Firsters and their supporters, such as Darryl Cherney, Julia Butterfly, and Bonnie Raitt have some pretty deep pockets.

Ironic how people accuse PL and the tree climbers of "breaking the law", when the tree sitters themselves are breaking the law. People protest PL, weather they deserve it or not is not the point, however they protest logging during the day, and live in a wood house or apartment at night. If you want to protest logging then you should cease your use, and support of all paper products. Including toilet paper.

So far the tree climbers have not hurt anyone, I think Eric is doing a great job, and he should be commended. How is he different than a police officer, other than not being sworn in, etc...?? He puts his life in danger every time he enters a tree with those smelly tree rats. I think they should shoot the climbers with tranq darts to get them down, or just let some nice pepper spray drift up to them for a few days, how about bring out some spot lights and light them up 24-7 like they are sitting in the sun, blast loud non lesbo music 24-7, lots of ways this could go, Eric is your salvation.
