Sonora, CA -- The Tuolumne County District Attorney's Office is taking the Sierra Railroad to court, charging that the railroad is in violation of a 2002 agreement to power its locomotives with bio-diesel fuel.
The complaint seeks $25,000 in damages resulting from a diesel spill in Chinese Camp five years ago.
That spill prompted the court-approved agreement between the county and the railroad that Sierra would begin powering its trains with bio-diesel fuel.
Railroad officials say the fuel is too expensive because it has to be trucked in from out of state. The railroad says an affordable source for bio-diesel is being actively sought.
A hearing is scheduled for July 7th in Tuolumne County Superior court.
